Just because the perpertrator did not acutally use the knife during the rape does not mean that it was not ever present in the mind of the person he attacked. And in any event, Rape on its own, with or without the other compounding factors carries a potential life sentance. I dont know the evidence that was before the judge on the day but this person should have been given a custodial sentance...period. It is often hard enough to get a conviction for rape in the first place without the compounding insult to the perpertators victim that the trauma they went through is not considered serious enough to send this person to prison for.
